Terms of Service

These Terms of Service ("Terms") constitute a legally binding agreement between you (or the organization you represent) and Etapsky Inc. ("Etapsky", "we", "us", or "our") governing your access to and use of the Etapsky platform, APIs, documentation, and related services (the "Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Acceptance of Terms
By creating an account, accessing the API, or using any part of the Service, you confirm that you are at least 18 years old (or the age of legal majority in your jurisdiction), have the authority to bind the organization you represent (if any), and accept these Terms in full. If you are using the Service on behalf of a company or other legal entity, you represent that you have authority to bind that entity.
2. Description of Service
Etapsky provides infrastructure for the Smart Document Format (SDF) — an open standard that bundles structured JSON data and a human-readable PDF into a single, digitally-signed, machine-verifiable file. The Service includes:

3. Account Registration
- You must provide accurate, current, and complete information when registering.
- You are responsible for maintaining the confidentiality of your credentials, including API keys and passwords.
- You are responsible for all activity that occurs under your account. Notify us immediately at security@etapsky.com if you suspect unauthorized access.
- Accounts are per-organization (tenant). Each tenant is isolated at the data layer. Sharing credentials across organizations is prohibited.
- You may not create accounts for automated scraping, abuse testing, or any purpose other than legitimate use of the SDF platform.
4. Acceptable Use
You agree not to use the Service to:
- Violate any applicable law, regulation, or third-party rights
- Upload documents that contain malware, exploits, executable code within PDF visual layers (JavaScript, AcroForm scripts, macros), or any content designed to harm systems
- Attempt to circumvent rate limits, authentication, or security controls
- Access, probe, or scan other tenants' data or infrastructure
- Conduct denial-of-service attacks, fuzzing, or load testing without prior written consent
- Reverse-engineer, decompile, or attempt to extract the source code of any proprietary components
- Resell or sublicense access to the Service without a written reseller agreement
- Use the Service for storing or processing data subject to export controls without ensuring compliance
Violation of this section may result in immediate account suspension without refund.
5. API Access & Rate Limits
API access is granted via API keys tied to your tenant. Rate limits are enforced per tenant independently. The default limit is 60 requests per minute; higher limits are available on paid plans.
- API keys must not be exposed in client-side code, public repositories, or shared documents.
- Etapsky is not responsible for unauthorized use resulting from your disclosure of API keys.
- We reserve the right to revoke API keys that are being used in violation of these Terms.
- SDF file uploads are subject to a 50 MB per-file limit and 200 MB total uncompressed limit per archive.
6. Subscription & Billing
- The Service is offered on a subscription basis. Plans and pricing are listed at etapsky.com/subscription.
- Subscriptions renew automatically at the end of each billing period unless cancelled before the renewal date.
- All fees are exclusive of applicable taxes. You are responsible for taxes imposed by your jurisdiction.
- Refunds are not provided for partial billing periods, except where required by applicable law.
- We reserve the right to modify pricing with 30 days' advance notice. Continued use after the effective date constitutes acceptance of the new pricing.
- Failure to pay invoices may result in service suspension after a 7-day grace period.
7. Document Data & Intellectual Property
7.1 Your content
You retain all rights to the documents and data you upload to the Service. Etapsky claims no ownership over your SDF files, document data, or schemas. You grant Etapsky a limited, non-exclusive license to store, process, transmit, and display your content solely as necessary to provide the Service.
7.2 Etapsky intellectual property
The Etapsky name, logo, platform software, and proprietary services are the intellectual property of Etapsky Inc. Open-source components are licensed separately — see Section 8. You may not use Etapsky trademarks without prior written consent.
7.3 Feedback
Any feedback, suggestions, or ideas you provide about the Service may be used by Etapsky without restriction or compensation.

BUSL-1.1 permits use for any non-production purpose and for individual developers in production. Restrictions apply to commercial SaaS offerings that compete directly with Etapsky. The full license text is at github.com/etapsky/sdf/blob/main/LICENSE.
9. Service Availability & SLA
Etapsky targets 99.9% monthly uptime for paid plans. Current status and incident history are published at status.etapsky.com.
- Scheduled maintenance windows are announced at least 48 hours in advance.
- Emergency maintenance may occur without notice when necessary to protect data integrity or security.
- Service credits for SLA violations are available on Business and Enterprise plans. Contact contact@etapsky.com within 30 days of an incident to claim credits.
- The Free plan is provided as-is with no uptime guarantee.
10. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. ETAPSKY DISCLAIMS ALL WARRANTIES INCLUDING, WITHOUT LIMITATION, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. ETAPSKY DOES NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE, UNINTERRUPTED, OR SECURE. YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL ETAPSKY, ITS DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE. ETAPSKY'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNTS PAID BY YOU TO ETAPSKY IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR USD $100 IF NO PAYMENTS HAVE BEEN MADE.
12. Indemnification
You agree to indemnify, defend, and hold harmless Etapsky and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorney's fees) arising out of or in any way connected with your access to or use of the Service, your violation of these Terms, or your violation of any rights of another party.
13. Termination
- You may terminate your account at any time by deleting it through the portal or by emailing contact@etapsky.com.
- Etapsky may suspend or terminate your account immediately and without notice if you violate these Terms, particularly Sections 4 (Acceptable Use) or if payment is overdue beyond the grace period.
- Upon termination, your access to the Service will cease and your data will be retained for the period described in the Privacy Policy, then deleted.
- Sections 7 (IP), 10 (Disclaimers), 11 (Liability), 12 (Indemnification), and 14 (Governing Law) survive termination.
14. Governing Law
These Terms are governed by the laws of the jurisdiction in which Etapsky Inc. is incorporated, without regard to conflict-of-law principles. Any dispute arising from these Terms shall be resolved through binding arbitration, except that either party may seek injunctive relief in a court of competent jurisdiction to protect intellectual property or confidential information. For enterprise customers, the governing law may be amended by a separately executed Master Services Agreement.
15. Changes to Terms
We reserve the right to update these Terms at any time. Material changes will be communicated via email (if you have an account) and by updating the "Last updated" date above. Continued use of the Service after the effective date of changes constitutes your acceptance of the revised Terms. If you do not agree, you must stop using the Service and terminate your account.
